Event Overview:
Traditionally, standard essential patent (SEP) licensing negotiations have taken place mainly among companies specializing in information and communications technology, or ICT. But as the Internet of Things (IoT) grows, companies from a spectrum of industries have begun using ICT standards, raising the possibility that they, too, will be brought to the negotiating table. As the parties to licensing negotiations become more diverse, various aspects of those negotiations are about to change—and it may become more difficult to resolve disputes through cross-licensing. In this session, Hiroyuki Hashimoto of Shiga International Patent Office will explore the Japan Patent Office (JPO) Guide to Licensing Negotiations Involving Standard Essential Patents, which was released on June 5, 2018, and provides SEP policies designed to prevent disputes and to promote the widespread use of the SEPs necessary for implementing technical standards. You will gain a better understanding of the guide as well as how SEP negotiations in United States, Europe, and Japan differ, good faith and efficiency in negotiations, and the arbitration and mediation process proposed by the JPO.
